These Terms of Service govern the relationship between you and TBX Academy Ltd, a company whose registered and operating address is 165 High Street, Harborne, Birmingham - B17 9QE, United Kingdom (GB). They apply to your use of this website and to the education and systems design services that the company provides.
Please read these terms carefully before you use the site or enrol in a course. By using the site, by submitting an enquiry or by accepting a place on a course, you agree to these terms. If you do not agree, you should not use the site or the services.
Where you are acting on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms, and the words you and your include the organisation.
In these terms, the following words have the meanings given below. Other words are defined where they appear in the text.
The website and services are intended for people who are able to enter into a binding contract. If you are under the age of eighteen, you may use the website only with the involvement of a parent or guardian, and an enrolment must be confirmed by a parent or guardian where the law requires it.
The company may refuse an application or an enrolment where the applicant does not meet the entry requirements of the course, where the information provided is inaccurate, or where accepting the applicant would put the safety or wellbeing of other students or staff at risk.
Courses may be delivered in person at the Harborne address, online, or in a combination of the two. The brochure for each course states the delivery mode, and the company will give reasonable notice of any change.
The company provides two broad families of service. The first is education, including enrolment, teaching, placement assessment, scholarship support and alumni communication. The second is computer integrated systems design for organisations in professional, scientific and technical services.
The education services are described on the services page of this website. They include enrolment packet desks, open day registers, course brochure runs, scholarship file reviews, placement test windows and alumni letter rounds. The company may adjust the detail of a service from time to time, provided that the substance of the service is not reduced during a course that has already begun.
The systems design services are provided under a separate written agreement or statement of work. Where a statement of work conflicts with these terms, the statement of work takes precedence for the engagement it describes.
An application does not create a contract. A contract is formed only when the company issues a written confirmation of a place and the applicant accepts it, usually by confirming acceptance and paying any deposit that the offer requires.
The company may make an offer conditional on evidence of prior study, on the outcome of a placement test or on the payment of a deposit. The conditions are stated in the offer, and the offer lapses if the conditions are not met by the stated date.
Once a place is accepted, the enrolment packet desk assembles the joining bundle and confirms the named contact for the first term. You are responsible for ensuring that the contact details you provide are accurate, so that the packet reaches you and so that any change to the timetable can be communicated.
The fees for a course are stated in the current course brochure and in the offer letter. Fees are payable in the amounts and on the dates set out in the offer. Where a payment plan is offered, the plan forms part of the contract.
Payments are due in advance of the periods they cover. If a payment is late, the company may suspend access to the course until the amount is paid, and it will give reasonable notice before doing so. The company will act fairly and will consider any circumstance you raise in good time.
The company does not store card details on its own systems. Card payments are processed by a payment provider, and the provider applies its own security and data protection practices.
A student is expected to attend the scheduled sessions, to complete the work set between sessions and to take part in the assessment that the course requires. Attendance is recorded so that the company can support a student who is falling behind and so that the integrity of the course is maintained.
Every student is expected to treat staff and fellow students with respect. The company may take reasonable action where conduct disrupts teaching, endangers others or brings the institution into disrepute. Action may include a warning, a requirement to attend a meeting or, in serious cases, the suspension or termination of a place.
The company will not tolerate harassment, discrimination or violence in any form. A concern about conduct may be raised with the admissions desk, and it will be handled confidentially and fairly.
Placement tests are held in published windows. By sitting a placement test, you agree to follow the instructions of the invigilator, to use only the materials that are permitted and to complete the test honestly.
The result of a placement test is used to recommend a starting level. The recommendation is advisory where the course allows flexibility, and it is binding where the course requires a minimum level for safety or for the coherence of the group.
A candidate may request one reassessment within the following window. The company will consider the request in good faith and will record the outcome. The decision of the company on placement is final, subject to the complaints process described in these terms.
Scholarship awards are made at the discretion of the company on the basis of a file review. An award is specific to the course and the intake for which it is made, and it is not transferable to another person or to a later intake without the written agreement of the company.
An applicant who receives an award must provide accurate information in the scholarship file. If the company discovers that material information was false or misleading, it may withdraw the award and, where a place has been accepted on the strength of it, reconsider the place.
The company will explain the reason for a scholarship decision in writing. It will not disclose the contents of a scholarship file to any other applicant, and it will handle the file in accordance with the Privacy Policy.
You may cancel an accepted place by written notice to the admissions desk. If you cancel more than fourteen days before the course begins, the company will refund any fees paid other than a deposit that the offer states is non refundable. If you cancel within fourteen days of the start, the company will refund fees other than the deposit and any cost it has already committed on your behalf, such as printed materials.
Once a course has begun, fees are generally not refundable. The company may, at its discretion, make a partial refund where a student withdraws for a serious reason such as illness, and it will consider each request on its merits.
If the company cancels a course, it will offer a transfer to another course or a full refund of fees paid for the cancelled course. The company will give as much notice as it reasonably can and will not charge a cancellation fee in these circumstances.
Systems design services are provided under a written agreement that sets out the scope, the deliverables, the timetable and the fees. The client agrees to provide accurate information and timely access to the people and systems that the engagement requires.
Intellectual property in the deliverables is dealt with in the agreement. Unless the agreement says otherwise, the client receives a licence to use the deliverables for the purpose for which they were commissioned, and the company retains ownership of its underlying methods and tools.
A client is responsible for the lawful use of the systems that the company designs. The company will design to the requirements it is given, and it will tell the client where a requirement raises a legal, security or ethical concern.
You may use this website for lawful purposes connected with the services. You must not attempt to gain unauthorised access to the site or to the systems behind it, interfere with its operation, or use it to distribute malicious code.
The company may suspend or withdraw access to the website for maintenance or for a reason connected to security. It will restore access as soon as it reasonably can and will not be liable for a temporary interruption that is outside its control.
The content of this website is provided for general information. It is not a substitute for the course brochure or for the offer letter, and where there is a conflict between the website and a formal document, the formal document prevails.
The company owns or licenses all intellectual property in the website, the course materials and the documents that it produces. This includes the text, the layout, the design of the services and the materials used in teaching.
You may view and print pages of the website for your own personal use. You may not reproduce, distribute or create derivative works from the content without the written permission of the company, except where the law expressly permits it.
Course materials are provided to a student for study on the course. They may not be shared with a third party or used for commercial purposes without the written permission of the company.
When you submit information through the website, such as the contact form, you confirm that the information is accurate and that you have the right to share it. You grant the company permission to use the information for the purpose for which it was submitted.
You are responsible for the content of your submission. You must not submit material that is unlawful, defamatory, or that infringes the rights of another person. The company may remove a submission that breaches these terms and may refuse to act on it.
The company handles your submission in accordance with the Privacy Policy, which explains the rights you have over the information you provide.
Nothing in these terms limits the liability of the company for death or personal injury caused by its negligence, for fraud or for any other liability that cannot be limited by law.
Subject to the paragraph above, the company is not liable for indirect or consequential loss, for loss of profit, for loss of opportunity or for loss of data that results from your use of the website or the services. The company is not liable for a loss that was not reasonably foreseeable when the contract was formed.
Where the company is liable under a course contract, its total liability is limited to the fees paid for the course in question. Where the company is liable under a systems design agreement, its total liability is limited as set out in that agreement.
You agree to indemnify the company against any claim, loss or cost that arises from your breach of these terms, from your misuse of the website or from a submission that infringes the rights of another person.
The indemnity applies only to the extent that the loss is caused by your conduct and not by the conduct of the company. The company will tell you promptly about any claim and will allow you to take part in the response where it is reasonable to do so.
The company collects and uses personal information in accordance with the Privacy Policy, which forms part of these terms. The Privacy Policy explains the information collected, the purposes for which it is used, the length of time it is kept and the rights that you have.
You should read the Privacy Policy before submitting personal information through the website or through the admissions desk. If you have a question about the handling of your information, you may write to the desk at any time.
This website may contain links to websites operated by other organisations. The links are provided for convenience, and the company does not control the content or the practices of the linked sites.
A link does not imply that the company endorses the linked site or its services. You use a linked site at your own risk, and you should read its terms and its privacy policy before relying on it.
The company is not liable for a failure or delay in performing its obligations where the failure or delay is caused by an event outside its reasonable control. Such events include severe weather, a public health emergency, a failure of a utility or telecommunications provider, and industrial action.
Where a force majeure event affects a course, the company will make reasonable efforts to reschedule the affected sessions or to deliver them online. If the event continues for a prolonged period, either party may end the affected contract, and the company will refund fees for the part of the course that it could not deliver.
The company may terminate a contract for a course if a student breaches these terms in a serious way, if a fee remains unpaid after reasonable notice, or if continuing the contract would put the safety of others at risk.
You may terminate a contract in accordance with the cancellation section above. A termination does not affect any right or obligation that has already arisen, including an obligation to pay a fee for a service that has already been provided.
On termination, the company will provide a written statement of the position, including any refund due, within a reasonable time. Records are retained in accordance with the Privacy Policy and the retention periods described in it.
These terms are governed by the law of England and Wales. Any dispute that cannot be resolved through discussion will be subject to the exclusive jurisdiction of the courts of England and Wales.
Before starting a legal process, both parties agree to try in good faith to resolve the dispute through a written exchange followed, if necessary, by a meeting. This does not prevent either party from seeking urgent relief from a court where it is necessary to protect a legal right.
The company may update these terms from time to time. When it does, it will update the date at the top of this page and, where a change is significant, it will inform current students and clients by email or by letter.
A change does not apply retrospectively to a contract that has already been formed, unless the change is required by law. The terms that applied when a contract was formed continue to govern that contract.
For any question about these terms, write to TBX Academy Ltd, 165 High Street, Harborne, Birmingham - B17 9QE, United Kingdom (GB). Email admissions@tbxacademy.buzz or call +16063573993 during business hours.
